General Provisions

Introduction

By receiving service from Rowenix Information Technologies "www.Rowenix.com" (hereinafter referred to as Rowenix) and/or Rowenix Information Technologies Website, you will have accepted all the conditions in this agreement. Rowenix, the preparers of all kinds of content on this site, its employees, persons and organizations authorized by Rowenix have no penal and legal liability for any requests related to material/moral damage that may arise from not reading these terms or not acting in accordance with them despite reading them.

Agreement Modifications

Rowenix reserves the right to unilaterally update and change this agreement at any time without prior notice.

Information Sources

All kinds of information, statistical figures, and values on the Rowenix website have been compiled by obtaining them from sources whose reliability is accepted within the framework of general practices, and their accuracy and adequacy are in no way guaranteed by Rowenix. Rowenix has no personal, legal, and penal liability for direct or indirect material and/or moral damages that may arise as a result of the use of information, evaluation, comments, and statistical figures and values on the Rowenix website.

Legal Evidence

Before receiving service from Rowenix, it is presumed and accepted by you that you have read the warnings and statements in this agreement, and in case of any dispute, claim, and demand, it is accepted and undertaken that the statements written on this page and all other computer records of Rowenix will be presented as the sole and real exclusive evidence.

1.) Order and Service Delivery

Setup Time

After the order you placed passes the fraud control and your payment is received, your account will be set up and your details will be sent to you. Although services are automatically set up for payments made by credit card, the setup process can take up to 48 hours in case of a possible problem. For payments made by wire transfer or EFT to our bank and postal check accounts, the maximum setup time is 2 business days, and the delivery time for software and license services is a maximum of 1 week. If delivery is not made within the specified time frame, Rowenix has an obligation to refund your fee if you request it.

Email Responsibility

During the order, it is your responsibility to provide an active, problem-free email address that you use. It is your responsibility to constantly keep your email address updated and check it. All emails sent to you are considered to have reached you. Rowenix has no legal and penal liability for any damages and losses that may occur if the emails sent to you are not received.

Form Details

All information in the form you fill out during the order or while registering to our site must be correct and complete. In orders canceled due to incorrect information, Rowenix reserves the right not to issue a refund or to issue a partial refund.

Security Verification

In cases where it deems necessary, Rowenix may request a photocopy/scanned image of a credit card or a photocopy/scanned image of an identity card for security purposes. If you do not provide these, your order may be canceled and treated as fraudulent, or the service/services you receive may be suspended. For accounts suspended due to fraud, Rowenix reserves the right not to issue a refund or to issue a partial refund.

2.) Payment and Service Renewal

Payment Obligation

As long as you receive service from Rowenix, you agree to pay Rowenix the fee for the service you receive. As long as you pay the renewal invoice for the service you receive, the service will continue to be renewed, and an invoice will be generated for the service you will receive during the renewal period.

Service Cancellation

If you do not want to continue receiving the service, you can send a cancellation request for your service from the customer panel. Service cancellation must be done from your customer panel. On the cancellation page, there are options available to cancel the service immediately or when it expires.

Payment Delays

If the invoice is not paid on time, Rowenix will give an additional 3 days to pay the invoice for all services, during this process your service will be suspended. 3 days after the due date, the service you receive will be completely terminated. It is not possible to recover these completely terminated services, they will be permanently deleted from the system.

Overpayments

Overpayments made accidentally and/or knowingly are added to your account as credit. You can use this added credit for subsequent services you will receive from Rowenix.

Price Changes

Rowenix reserves the right to change the prices of its products at any time without prior notice.

Chargeback and Dispute

In cases where the fee is withdrawn (dispute, chargeback, etc.) using payment channels without the knowledge and/or permission of Rowenix, it is your responsibility to cover all material and moral damages inflicted on Rowenix.

3.) Service Cancellation and Refund Conditions

Unilateral Cancellation Right

Rowenix reserves the right to terminate any service unilaterally at any time without notice, without giving a reason, without refunding or by making a partial refund.

Refund Procedure

Rowenix will always take care to act constructively in refund requests, it will contact the customer to determine whether the problem experienced is caused by Rowenix. If the problem is caused by Rowenix, the refund request will be approved.

Refund Process and Fees

For refund requests approved by Rowenix, if the customer cannot issue a return invoice, it makes a deduction equal to the VAT rate, and if any, refunds the remaining amount after deducting the bank wire transfer/EFT or Virtual POS commission fee. In case a refund request is made, Rowenix reserves the right to fulfill this request within 5 days at the earliest and 1 month at the latest. The refund can only be made to the bank account/card that made the payment.

Customer Behavior

Insulting/rude behavior towards any of our employees will result in the suspension/termination of your account/service. In such a case, your membership will be terminated without any refund and the contract will be annulled. You commit to refrain from all kinds of comments, behaviors, advertisements, posters, writings, and words that may damage the commercial reputation of Rowenix employees. In case of contrary behavior, you accept that competent courts are authorized.

Server Attacks

Applications experiencing DDoS etc. attacks that indirectly or directly damage our servers and/or cause problems such as slowdown/interruption can be terminated without notice and without refund. In such cases, Rowenix may demand that you cover the resulting damage.

Early Termination Policy

For paid services, if the service is canceled before the service period expires, the full service fee or the fee for the unused period will not be refunded. You can use the credit in your account for the services you can receive from us, but there will be no refund for services that will be terminated early.

4a.) Server Usage

Password Reset and Responsibility

Rowenix reserves the right to reset the password of any VDS-VPS or dedicated server service it offers. Keeping a valid email address and root password registered in our system is the responsibility of the customer. All data and backup of data are the responsibility of the customer.

Resource Usage Restriction

In VDS services, intensive resource usage that damages other dedicated servers in any way cannot be made.

Operating System Change

In servers where the operating system is automatically installed via the VDS panel, there is a right to change a maximum of 15 times within 1 month. For manual operating systems, the right to change is 2. When these limits are exceeded, it reserves the right to request a fee for a new installation process.

CPU Usage Limit

You can use 1 Ghz for each number of cores you purchase on the servers. For example, when you purchase an 8 Core server, a fair use restriction will be applied at 8000 Mhz.

Malfunction and Maintenance Operations

Rowenix reserves the right to occasionally experience interruptions for mandatory maintenance operations such as hardware replacement and software updates in its infrastructure. Mandatory downtime periods are not included in the specified downtime periods.

4b.) Hosting Usage

Difference Between Domain and Hosting

Rowenix only provides hosting and server services, domain name registration is completely a third-party service. Rowenix has no legal and penal liability for any problems experienced with any domain name. Hosting and domain names are separate products.

Email Service

Email services are a secondary service offered alongside shared hosting services. Rowenix has no legal and penal liability for any problems experienced in email services.

Resource Usage Limits

The term "unlimited" in unlimited packages in shared hosting services means; no limitation or quota will be applied provided that usage is made within the framework of the fair use policy. If the fair use policy is violated, the resource limit to be applied is determined by Rowenix.

Account Security

It is your responsibility to securely store your hosting account password and other login information. Rowenix cannot be held responsible for damages that may occur in case of unauthorized access or abuse to your account.

5.) Prohibited and Unauthorized Content

Content Responsibility

You are personally responsible for all the content you host, distribute, and publish, and the software you use in the services you receive from Rowenix. Rowenix is not obliged to control the unauthorized use of content or software.

Prohibited Content

Hosting and/or distributing the following content is strictly prohibited, and your account will be terminated immediately upon detection:

• Illegal content
• Materials involving copyright infringement
• Child sexual abuse material (CSAM)
• Hate speech and incitement to violence
• Malicious software (malware, phishing, etc.)
• Unauthorized access tools and cracked software
• Spam and bulk messaging systems
• Illegal betting and gambling sites
• Cryptocurrency mining (unauthorized)

6.) Privacy and Data Protection

Personal Data

Rowenix protects and processes the personal data of its customers within the framework of the General Data Protection Regulation (GDPR). For detailed information, you can review our Privacy Policy.

Legal Disclosure

Rowenix reserves the right to share the necessary information without prior notice to the customer upon the request of legal authorities.

7.) Technical Support

Support Scope

Rowenix provides support related to the technical infrastructure of the service you purchased. Support on issues such as third-party software you use, coding errors, and custom configurations may be limited or subject to an additional fee.

Support Channels

You must submit your technical support requests via the support ticket system. Phone support is available for emergencies only. The average response time is between 1-24 hours.

8.) Limitation of Liability

Material Damage

Rowenix's liability for material damages arising from service interruption, data loss, or other technical problems is limited to the monthly fee received for the relevant service.

Moral Damage

Rowenix cannot be held responsible for indirect damages, loss of profit, or loss of business that may arise from the use of the services.

9.) Competent Court and Execution Offices

Jurisdiction

The competent courts and execution offices are authorized to resolve any disputes that may arise during the implementation of this agreement.
