1. General Provisions & Acceptance
Parties & Scope
This Terms of Service Agreement ("Agreement") is entered into between ROWENIX DIGITAL SOLUTIONS LLC ("Rowenix", "Company", "we", "us", or "our") and the natural or legal person subscribing to, purchasing, or utilizing any services ("Customer", "User", or "you") accessible via www.rowenix.com and associated infrastructure.
Binding Acceptance
By registering an account, purchasing any hosting or server plan, or utilizing our services, you expressly acknowledge and agree to be bound by all terms, conditions, and incorporated policies set forth in this document.
Agreement Modifications
Rowenix reserves the right to amend, update, or revise this Agreement at any time. Major revisions will be communicated through account notifications or email. Continued use of our infrastructure following any modifications constitutes full acceptance of the updated terms.
2. Account Registration & Service Delivery
Account Accuracy
During registration, customers must provide accurate, current, and complete contact details, including a valid email address and legal billing information. Customers are solely responsible for maintaining the confidentiality of their credentials and account security.
Automated Provisioning & Delivery Timelines
Standard Web Hosting, WordPress Hosting, and Virtual Private Server (VDS/VPS) services are provisioned automatically upon successful fraud verification and payment confirmation. If manual fraud review or custom network configuration is required, provisioning is completed within 1 to 24 hours. Dedicated server configurations are deployed within 24 to 48 hours.
Security Verification & Fraud Prevention
To ensure platform integrity and prevent unauthorized card usage, Rowenix reserves the right to request identity verification for accounts flagged by automated risk-scoring systems before activating or continuing services.
3. Billing, Invoicing & Service Renewal
Payment Terms
Services are billed on a recurring pre-paid subscription basis (monthly, semi-annually, or annually). Renewal invoices are automatically issued 7 days before the expiration date.
Grace Period, Suspension & Termination
If an invoice remains unpaid past the due date, a 3-day grace period is provided during which services remain operational. Following the grace period, unpaid accounts are temporarily suspended. If settlement is not made within 7 days post-suspension, the service and associated data will be permanently terminated and purged from our systems.
Price Adjustments
Rowenix reserves the right to adjust service pricing with a minimum of 30 days prior written notice before subsequent renewal terms. Active pre-paid terms are unaffected by price adjustments.
4. Acceptable Use Policy (AUP) & Prohibited Content
Customer Content Responsibility
Customers bear sole legal responsibility for all websites, scripts, applications, files, and databases hosted on their servers. Content must comply with all applicable local, state, federal, and international laws.
Strictly Prohibited Activities
The following activities are strictly prohibited across all Rowenix infrastructure and will result in immediate termination without refund:
• Sending unsolicited commercial email, mass email, or SPAM
• Hosting malware, phishing portals, botnets, exploit kits, or spyware
• Initiating, facilitating, or participating in Denial of Service (DDoS) attacks
• Unauthorized cryptocurrency mining or unauthorized resource exhaustion
• Copyright infringement, pirated media, cracked software (Warez), and DMCA violations
• Child sexual abuse material (CSAM) or any illicit exploitation material
• Unlicensed gambling, illegal pharmaceutical sales, and online financial scams
5. Backup Policy & Data Protection
Customer Data Responsibility
While Rowenix employs automated server snapshot backups for disaster recovery purposes, the Customer is strictly responsible for maintaining independent, regular off-site backups of their critical data, databases, and emails. Rowenix is not liable for data loss resulting from software failure, user deletion, or account termination.
6. Limitation of Liability & Governing Law
Limitation of Liability
In no event shall Rowenix, its officers, or employees be liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business goodwill). Rowenix's aggregate liability for any direct claim is strictly capped at the amount paid by the Customer for the specific service during the single month in which the claim arose.
Jurisdiction & Governing Law
This Agreement is governed by and construed under the laws of the State of Wyoming, United States of America. Any legal dispute or proceeding arising out of this Agreement shall be resolved exclusively in the state and federal courts located in Sheridan County, Wyoming.
